What is surrogacy, exactly?

Surrogacy is the process by which a woman voluntarily accepts to gestate for a couple who will act as the legal parents of the baby, after delivery.

This practice is also known as "surrogacy" or "surrogate motherhood" and there are different modalities throughout the world. In some cases the parents who will acquire the legal care of the child donate the gametes, and in others the woman who gestate contributes her genetic material.

This action raises controversy, because in some cases surrogacy is financially compensated, while in others it is an act of goodwill, in case the couple who wish to keep custody of the baby has physiological difficulties.

How does a surrogacy in Mexico take place?

In Mexico there are two states where legal surrogacy contracts are allowed, which are Tabasco and Sinaloa. In these states there are regulations that manage civil matters and health issues; however, in the country there is a lack of regulation on the correct use of assisted reproduction techniques, so there is a vulnerability towards the people involved in surrogacy processes.

Among these shortcomings is the deficient regulation of surrogacy, the absence of federal regulation regarding this issue and human rights violations, such as discrimination, violations of the right to security and identity.

In Mexico, there are organizations in the form of associations that propose, on "catalog", women who present themselves to be surrogate mothers. Tests are carried out on the latter to verify that she is in good health, that she has no psychological problems and to eliminate the risk of medical contraindications.

In the vast majority of countries, the woman must have already had a child in order to prevent her from becoming attached to him during her pregnancy. An agreement is then established between the intended parents and the surrogate mother, according to the terms that each wishes, says the lawyer specializing in health law.

Then, the insemination takes place, then nine months pass with a very strict medical follow-up. At the time of the delivery, often the parents of intention are there. Only one of them can be considered as the parent, the other will have to adopt the child.

The legal situation of surrogacy in Mexico

Beyond the ethical and moral debates that can be given around surrogacy, it is a fact that its practice is given, it should be a topic to be discussed and above all to be regulated, in order to find solutions that protect all parties involved.

With respect to Tabasco, in 1997, surrogacy was regulated in a civil manner, which means that children born under these processes could be registered, but there was a vacuum with respect to the protection of the parties involved.

For its part, in Sinaloa this regulation was entered into the civil code in 2013, however, the restrictions to access agreements have limited Sinaloa to have the media visibility that Tabasco has in terms of surrogacy.

As national states are independent in terms of their civil codes, states such as Coahuila and Querétaro explicitly disregard all surrogacy agreements, recognizing the maternity only of the gestating woman. In the rest of the country this practice remains unregulated.

What are the risks of surrogacy in Mexico

For the surrogate mother, the medical risks are more or less the same as those inherent to a natural pregnancy, namely: miscarriage, risk of multiple pregnancy, gestational diabetes or even hemorrhage and death.

Other risks, notably psychological, exist. As for the child, the pitfall of this type of procreation is that it presents, in the eyes of the parents of intention, a problem of conformity with what they expected: a defect, a color of eyes, a difference of skin tone, or a character different from the one expected.

This sometimes gives rise to truly difficult disputes, especially humanly, for all the parties involved in this conception.

What is a surrogate mother in Mexico?

A surrogate mother offers herself to help couples with infertility problems by carrying and delivering their baby. The child born from an embryo, resulting from the couple's gametes, transferred through a process of In Vitro Fertilization (IVF) to the uterus of the surrogate mother, who will not have a genetic link with the baby.

If the intended mother cannot bring her eggs, eggs from an anonymous donor are used to inseminate the surrogate mother. The surrogate mother's eggs should never be used.

This surrogacy technique is legal in countries such as Mexico, the United States, Canada, and in Europe, Russia, Ukraine, Greece or Georgia. Couples who use a surrogate mother in Mexico, have certainly tried to be parents with IVF, inseminations and, sometimes, they have tried to adopt.

Unlike artificial insemination, the surrogate program is much longer, more expensive and more complex.

It is important to know that it is also possible to use egg donation, if a surrogate mother is not an option for you.

Surrogacy in Mexico is also a good option for male homosexual couples who want to be parents.

Surrogacy for gay and lesbian couples

Restrictions also have situations that need to be addressed, such as discussions that seek to create regulations defending pregnant women and children born from these practices. This leaves a vacuum in terms of the rights of intentional parents, who are only allowed access to maternity and paternity as long as it is a couple formed by a man and a woman, leaving a legal and regulatory vacuum in terms of other modalities of couples.

In Mexico in 2017, a step forward was taken in this area, since the Supreme Court of Justice of the Nation issued a jurisprudence where it is ruled that, "family life between people of the same sex is not limited only to life as a couple, but can be extended to procreation and raising children according to the decision of the parents. Thus, there are same-sex couples who make family life with children procreated or adopted by one of them, or couples who use the means derived from scientific advances to procreate". This opens the door for same-sex couples to have access to surrogacy processes.

Who can access surrogacy in Mexico?

According to the few legal regulations on the subject, and the expansion of family rights of same-sex couples, there are no restrictions to access this practice, except for the states where it is stipulated its ignorance, as we saw above.

Any person who wants to make use of the surrogacy regulations of the states where they are regulated can access this process, from singles, heterosexual couples who cannot access a pregnancy, homosexual couples or foreign couples.

How much does surrogacy cost in Mexico?

As it is not a 100% regulated practice in the country, the costs of "renting a womb" can range from $50,000USD to $70,000USD. One way to have certainty regarding the costs, which so far are highly variable in Mexico, is to build a legislative framework that protects all parties involved in this process.

Since there is no federal regulation on the subject, and in many states there is a legal vacuum, clinics and health institutions can establish their own criteria for implementing these techniques, in addition to stipulating the costs without any type of legal restriction.

It should be noted that the economic risks are not the most serious, because in the absence of laws that regulate sufficiently, there may be cases of medical negligence, fraud, discrimination, legal insecurity, among other legal, economic and social loopholes that exist regarding surrogacy.
